Terms Of Service

 

These Terms of Service and any terms expressly incorporated here ("Terms") apply to your access to and use of the websites, APIs and mobile applications (collectively the “Crypdom Exchange Site”),  provided by Crypdom Exchange LLC (hereinafter referred to also as "we", or "us"), and the trading and direct sale services provided by Crypdom Exchange as described in these Terms (our "Services").

You agree and understand that by signing up to use an account through Crypdom Exchange Site you are agreeing to enter into this user agreement (the “Agreement”). You agree that you have read, understood, and accept all of the terms and conditions contained in this Agreement, as well as our Privacy Policy
By clicking “I Agree” or using any portion of the website you agree to be bound by this Agreement and the Privacy Policy.

DISCLAIMER
Crypdom Exchange does not assure the value of digital assets. You understand and agree that the value of digital assets is highly volatile and that by buying, selling, trading and holding of digital assets you incur in a high risk of loss. When considering to buy, sell, trade or hold digital assets, you should be aware that the price or value of digital assets can change rapidly, decrease, and potentially even fall to zero. If you are unable to bear the financial risk of loss, please do not use or access the Crypdom Exchange Site. You agree that you are solely responsible for any digital asset transactions and the use of the Crypdom Exchange Site. All services offered, marketed or promoted by Crypdom Exchange will be made available to users through the Crypdom Exchange website (www.trade.Crypdom.com). Crypdom Exchange does not offer its services through any other platform and does not ask its users to provide their Crypdom Exchange account passwords, their online banking or ATM passwords, debit/credit card CVV numbers or to make payments in person, via cash deposits or money transfer (MoneyGram,Western Union, etc).

1. Key Definitions
Capitalized terms not otherwise defined in these Terms will have the following meaning:

"Peripheral Account" means any Financial Account or Digital Asset Account: (i) from which you may load Funds into your Crypdom Exchange Account, and (ii) to which you may push Funds from your Crypdom Exchange Account.

"Financial Account" means any financial account of which you are the beneficial owner that is provided by a third party supplier outside of the Services, including, but not limited to accounts maintained by third party financial institutions or to third-party payment service accounts.

"Funds" means Digital Asset and / or Legal Tender.
"Legal Tender" means any national currency, that may be used in connection with a purchase or sale of Digital Assets via the Services, and does not include any Digital Asset.

"Digital Asset" means bitcoins, ethereum and other digital assets that may be purchased, sold or traded via the Services.

"Digital Asset Account" means any Digital Asset address or account owned or operated by you that is maintained outside of the Services, and is not owned, controlled or operated by Crypdom Exchange.

"Digital Asset Services" means the services provided under section 2.2.

"Crypdom Exchange Account" means a user account accessible via the Services where Funds may be stored by Crypdom Exchange on behalf of a user.
   
2. SERVICES
Crypdom Exchange offers the following services:
a) Crypdom Exchange Digital Asset Services and
b) Crypdom Exchange [xxxx] Services (referred to as “Crypdom Exchange Services”, each service is defined below).
Except as otherwise stated all services found on the Crypdom Exchange Platform are offered without warranty, “as-is,” and with “all faults.”
       
2.1. Eligibility.
You must be 18 years old or older to create your Crypdom Exchange account and use the Crypdom Exchange Site and accept the Terms. Due to United States regulations and federal laws, US residents or any persons accessing Crypdom Exchange from the US are strictly prohibited from using the Crypdom Exchange Site and such persons are prohibited from creating a Crypdom Exchange account. By using the Crypdom Exchange Site or registering for a Crypdom Exchange Account, you represent and warrant that you have the right, authority and capacity to enter into an agreement on these terms and to abide by these terms. You also represent and warrant that you: (a) have not previously been suspended or removed from using our Services; (b) have full power and authority to enter into this agreement and in doing so will not violate any other agreement to which you are a party; (c) will not use our Services if any applicable laws prohibit you from doing so in accordance with these Terms d) your Crypdom Exchange Account is personal and will only be used by you.
 
2.2. Digital Asset Services.
The following services (the “Digital Asset Services”) are provided to you by Crypdom Exchange, a limited liability company incorporated in the UA with license number XXXXXXXXXX and whose registered office Ukraine, Kiev.

a) A service enabling you to transfer digital assets into and digital assets out of your personal Multi-Signature (the “Multi-Signature Wallet”);

b) An interface with real-time order books, trade history, charting tools, and a simple order process (the “Exchange Platform”);
   
c) A service that, in addition to the Multi-Signature Wallet, allows you to purchase and sell digital assets (the “Broker Platform”).
       
2.3. Fees

2.3.1. Amount of Fees. 
You agree to pay Crypdom Exchange the fees for trades completed via our Services ("Fees") as made available via the Fees Page, which we may change at our discretion from time to time. Changes to the Fees are effective as of the effective date indicated in the posting of the revised Fees Page, and will apply prospectively to any exchange which takes place after the effective date of such revised Fees Page.
           
2.3.2. Third-Party Fees.
In addition to the Fees, the use of your Peripheral Account may impose fees in connection with your use of your designated Peripheral Account via the Services. Any fees imposed by your Peripheral Account provider will not be reflected on the transaction screens containing information regarding applicable Fees. You are solely responsible for paying any fees imposed by a Peripheral Account provider.
           
2.3.3. Payment of Fees. 
You authorize us, or our designated payment processor, to charge or deduct your Crypdom Exchange Account Funds for any applicable Fees owed in connection with trades you complete via the Services.

   
3. Crypdom Exchange ACCOUNT
       
3.1. Registration of a Crypdom Exchange Account. 
In order to use the Crypdom Exchange Services, you need to register for a verified Crypdom Exchange Account on the Crypdom Exchange Site by providing us with:
  
a) your first and last name,
b) an e-mail address,
c) a strong password that you do not use for any other website or online service,
d) a copy of your passport,
e) a personal picture,
f) a phone number.

We may, at our sole discretion, refuse to open a Crypdom Exchange Account for you.
       
3.2. Identity Verification. 
You agree to provide us with any and all information we request for the purposes of verifying your identity and for the detection of third-party payments, money laundering, terrorist financing (TF), fraud, or any other type of financial crime, and permit us to keep a record of such information indefinitely and share them with governmental authorities to comply with the applicable laws.

You will be required to complete certain verification procedures before you are permitted to use the Crypdom Exchange Services and your access to one or more Crypdom Exchange Services, and the limits that apply to your use of the Crypdom Exchange Services, may be altered as a result of information collected on an ongoing basis. The information we request may include certain personal information, including, but not limited to:

(a) your full name,
(b) your registered address,
(c) your registered telephone number (fixed or mobile), (d)your valid email address,
(e) your date of birth,
(f) your taxpayer identification number,
(g) your government identification number or your passport number, and
(i) information regarding your bank account (such as the name of the bank, the account type, the SWIFT code, the IBAN number, and the account number). In providing us with this or any other information that may be required by us for verification purposes, you confirm that the information you provide us is accurate and authentic.

You agree to keep us updated if any of the information you provide us changes. You authorize us to make any necessary inquiries, whether directly or through third parties, that we deem necessary in order to verify your identity or protect you and/or us against fraud or other financial crime, and to take any action we reasonably deem appropriate and necessary based on the results of such inquiries. When we carry out these investigations, you acknowledge and agree that your personal information may be disclosed to fraud prevention or financial crime agencies, and that these agencies may respond to our inquiries in full. Additionally, we may require you to wait a certain period of time after completion of a transaction, before permitting you to further use Crypdom Exchange Services and/or before permitting you to engage in transactions beyond certain limits.
       
3.3. Technical requirements.
To access the Crypdom Exchange Services and to retain electronic communications, you will need a computer with an Internet connection that has a web browser with cookies enabled and 128-bit encryption. You will also need to have a valid email address and have sufficient storage space to save past communications or an installed printer to print them.
       
3.4. Number of Crypdom Exchange Accounts.
Crypdom Exchange may, in its sole discretion, limit the number of Crypdom Exchange Accounts that you may hold, maintain or acquire.

4. PAYMENT SERVICES
       
4.1. Funding your Crypdom Exchange Account.
In order to complete an order or trade via the Services, you must first load Funds to your Crypdom Exchange Account using one of the approved Peripheral Accounts identified via the Services. You may be charged fees by the Peripheral Account you use to fund your Crypdom Exchange Account. Crypdom Exchange is not responsible for any Peripheral Account fees or for the management and security of any Peripheral Account. You are solely responsible for your use of any Peripheral Account, and you agree to comply with all terms and conditions applicable to any Peripheral Account.

The timing associated with the execution of a transaction will depend in part by the performance of third parties suppliers responsible for maintaining the applicable Peripheral Account, and Crypdom Exchange makes no guarantee regarding the amount of time it may take to load Funds into your Crypdom Exchange Account.
       
4.2. Funds Held In Your Crypdom Exchange Account. 
Be advised that fiat funds held in your Crypdom Exchange account are exclusively for the purchase of Digital Assets or withdrawal to your approved Peripheral Account. Proceeds from the sale of Digital Assets will be credited to your fiat account, less any transactional or other fees. Furthermore, be advised that Crypdom Exchange does not pay any interest on free fiat balances held in your account.
      
4.3. Payments compliance.
You hereby agree that any purchase, dispute or claim arising out of or in connection with any financial transaction performed on this website shall (a) be governed and construed in accordance with the laws of Sharjah, and (b) all credit or debit cards used to fund your Crypdom Exchange Account must be clearly stated with Visa and Mastercard logos. You further acknowledge and agree that Crypdom Exchange will not provide any financial services to any of the Office of Foreign Assets Control (“OFAC”) sanctioned countries in accordance with the law of the UA.

4.4. Purchase of Digital Assets. 
To purchase Digital Assets, you must follow the relevant instructions on the Crypdom Exchange Site.
       
4.5. Revocation. 
When you give us instructions to purchase or sell Digital Assets, you cannot withdraw your consent to that purchase or sell request.
       
4.6. Account Information. 
You will be able to see your Crypdom Exchange Account balance and your transaction history on the Crypdom Exchange Site, including
       
a) the amount (and currency) of each Digital Asset Purchase,
       
b) a reference to identify the buyer and/or seller (as appropriate),
       
c) any fees charged, where there has been a currency exchange, the rate of exchange, and the amount (in the new currency) after exchange (where you are the payer) or the amount (in the original currency) before the exchange (where you are the payee).

4.7. Consent to access, processing and storage of your personal data. 
You provide your explicit consent to us accessing, processing and retaining any personal information you provide to us for the purposes of us providing payment services (i.e. the Crypdom Exchange Services) to you. This consent is not related to, and does not affect, any rights or obligations we or you have in accordance with data protection laws and regulations. You can withdraw your consent to us providing payment processing services (to you at any time by closing your account with us. However, we may retain and continue to process your personal information for other purposes. Please our Privacy Policy for further information about how we process your personal data, and the rights you have in respect of this.
   
5. DIGITAL CURRENCY SERVICES
       
5.1. Summary.
Your Crypdom Exchange Account also allows you send Digital Assets, and request, receive, and store Digital Assets, and trade Digital Assets with third parties, through Crypdom Exchange, by giving instructions through the Crypdom Exchange Site (each such transaction is a “Digital Asset Transaction”).
       
5.2. Digital Asset Transactions. 
We will process Digital Asset Transactions in accordance with the instructions we receive from you. You should verify all transaction information prior to submitting the instructions to us. We do not guarantee the identity of any user, receiver, requestee or other party. Digital Asset Transactions cannot be reversed once they have been broadcast to the relevant Digital Asset blockchain.
           
5.2.1. Once submitted to the relevant Digital Asset blockchain, a Digital Asset Transaction will be unconfirmed for a period of time pending sufficient confirmation of the transaction by the Digital Asset blockchain. A Digital Asset Transaction is not complete while it is in a pending state. Digital Assets associated with Digital Asset Transactions that are in a pending state will be designated accordingly and will not be included in your Account balance or be available to conduct Digital Asset Transactions with.
           
5.2.2. By initiating a Digital Asset Transaction, you agree to pay any and all applicable fees related to the transaction including, but not limited to, account hosting fees, exchange fees, service fees, conversion fees, blockchain network fees or banking fees.
           
5.2.3. We reserve the right to refuse to process, or to cancel or reverse, any purchases or sales of Digital Assets at our sole discretion, including, but not limited to, instances where we suspect the transaction involves (or has a high risk of involvement in) a third party payment, money laundering, terrorist financing, fraud, or any other type of financial crime, in response to a subpoena, court order, or other government order, or if we suspect the transaction is unlawful or violates any other clause of this Agreement.
      
5.3. Supported Digital Assets. 
Our Digital Asset Services are only available in connection with those digital currencies that Crypdom Exchange supports, which may change from time to time. Under no circumstances should you attempt to use your Account to store, send, request, or receive Digital Assets in any form that we do not support. We assume no responsibility or liability in connection with any attempt to use your Account for digital currencies that we do not support. 5.4. Account Access and Keys.
When you create a Crypdom Exchange Account on the Crypdom Exchange Site, you will then be able to perform any Crypdom Exchange Service through your personal Account. Once a Crypdom Exchange Account has been successfully created, a Private Wallet Key, a Recovery Key, and a Third Party Security Key (“Key(s)”) will be generated that give you access to your Crypdom Exchange Account. Two keys will be required at any given time to initiate any Crypdom Exchange Transaction.
       
5.5. Private Wallet Key
The Private Wallet Key will be unique and only accessible by Crypdom Exchange. In order to perform a transaction on the Crypdom Exchange Site, you will be required to input your Crypdom Exchange password. Once a transaction is requested by you, Crypdom Exchange will review and authenticate the requested transaction and, once authenticated, will supply the Private Wallet Key that must be used in conjunction with the Third Party Security Key to initiate your requested Crypdom Exchange Transaction. Although your Crypdom Exchange Transaction may be verified, Crypdom Exchange is not liable or responsible for any transactions on your personal Crypdom Exchange Account. By performing a Crypdom Exchange Transaction on your Crypdom Exchange Account, you agree that you are solely responsible for any Crypdom Exchange Transaction placed. Please ensure your Crypdom Exchange Account password is stored safely and securely.
       
5.6. Third Party Security Key
Once a Crypdom Exchange Transaction has been requested by you, a Third Party Security Key will be provided by a third party security services provider contracted to hold the Third Party Security Key. The Third Party Security Provider will review and authenticate the Crypdom Exchange Transaction. If the Crypdom Exchange Transaction is deemed legitimate, the security provider will provide the Third Party Security Key. In the event that any fraudulent activity is suspected with your Crypdom Exchange Account, the security provider may decline to provide the Third Party Security Key.
Please be aware that we cannot control the approval or denial of any Crypdom Exchange Transactions by the Third Party Security Provider. Users may be required to enter into additional binding agreements with such Third Party Security Providers. We only act as the account vendor and makes no representations or warranties regarding the use of any services provided by the Third Party Security Provider. Crypdom Exchange does not have access to your Third Party Security Key and cannot be held responsible for any failure to approve a Crypdom Exchange Transaction by the Third Party Security Provider. We cannot be held responsible for any loss or damage to any Third Party Security Keys.
       
5.7. Recovery Key
In the event that either the Private Wallet Key or the Third Party Security Key gets compromised, Recovery Keys will be used to access your Crypdom Exchange Account. The Recovery Key will be stored and maintained by an independent legal services or accounting firm. In the event that a loss of the Private Wallet Key or Third Party Security Key occurs, an independent digital assets company will be contracted to provide you access to your Crypdom Exchange Account. This independent company will liaise with us and with the Third Party Security Key holder in order to recover your digital assets.
       
5.8. Private Wallet Keys storage
We securely store your Private Wallet keys in our control in a combination of online and offline storage. As a result, it may be necessary for us to retrieve certain information from offline storage in order to facilitate a Digital Asset Transaction in accordance with your instructions, and you acknowledge that this may delay the initiation or crediting of such Digital Asset Transactions.
       
5.9. Password confidentiality.
You agree to maintain the confidentiality of your password, any Wallet Keys (defined above), and all activities that occur through the use of your password or Wallet Key, and that you are fully responsible for all liability and damages resulting from your failure to maintain that confidentiality. You are solely responsible for your Crypdom Exchange Account, Wallet Key, and password and for any activities that occur within your Crypdom Exchange Account. You agree to immediately notify us of any unauthorized use of your password, Wallet Key, or any other breach of security. You agree that Crypdom Exchange cannot and will not be liable for any loss or damage arising from your failure to comply with this provision.
       
5.10. Advanced Protocols. 
Unless specifically announced on the Crypdom Exchange Site or other official public statements of Crypdom Exchange, we do not support metacoins, coloured coins, side chains, or other derivative, enhanced, or forked protocols, tokens, or coins which supplement or interact with a Digital Asset we support (collectively, “Advanced Protocols”). You should not use your Crypdom Exchange to attempt to receive, request, send, store, or engage in any type of transaction involving an Advanced Protocol. The Crypdom Exchange Site is not configured to detect and/or secure Advanced Protocol transactions. You acknowledge and agree that we have no responsibility whatsoever in respect of an unsupported Advanced Protocol.
       
5.11. Operation of Digital Asset Protocols. 
We do not own or control the underlying software protocols which govern the operation of Digital Assets supported on the Crypdom Exchange Site; generally, the underlying protocols are open source and anyone can use, copy, modify, and distribute them. We assume no responsibility for the operation of the underlying protocols and we are not able to guarantee their functionality, security, or availability.

You acknowledge and accept the risk that underlying software protocols relating to any Digital Asset you store in your Account may change.

In particular, the underlying protocols are likely to be subject to sudden changes in operating rules (“forks”), and such forks may materially affect the value, function, and/or the name of the Digital Asset you store in your Account. Where possible, we may provide you with notices or alerts on forks in accordance with Section

13.11. (Contact Information) below and you must read such notices or alerts received from us in order that you may consider how to deal with upcoming forks. However, it is your responsibility to make yourself aware of, and consider how to deal with, upcoming forks. In the event of a fork, there is a risk that we may need to temporarily suspend operations in relation to that fork without providing advance notice to you. We may, in our reasonable discretion, decline to support either or both branches of a fork.

You acknowledge the risks presented by forks and you accept that we have no responsibility to assist you to move or sell an unsupported branch of a forked protocol.
  
6. DIGITAL ASSET EXCHANGE SERVICES
       
6.1.  In General. 
The Digital Asset Exchange Service enables you to buy Digital Assets using:
   
• Central bank issued currency supported by Crypdom Exchange
Conversely, when you sell Digital Assets, you may choose to receive:
   
• A balance of another Digital Asset at the prevailing rate of exchange; and/or
   
• Central bank issued currency supported by Crypdom Exchange
       
6.2. Central Bank Currency Transactions.
You may purchase supported Digital Assets by linking a valid payment method to your Account. You authorize us to debit funds using your selected payment method(s) to complete your purchase. Although we will attempt to deliver Digital Assets to you as promptly as possible, funds may be debited from your selected payment method before the status of your Digital Asset transaction is shown as complete and is reflected in your Account balance.

You may sell Digital Assets in exchange for central bank issued currency supported by Crypdom Exchange, or for a balance of another Digital Asset at the prevailing rate of exchange. In such circumstances, you authorize us to debit your Account and to send instructions to credit your selected payment method(s) in settlement of sell transactions. We will send these instructions as soon as reasonably possible. Any central bank issued currency should be credited to your selected payment method(s) by the end of the business day after we send such instructions.
       
6.3. Transaction Fulfillment. 
We will do our best to fulfill all purchases of Digital Assets, but in some circumstances we may be unable to. If this is the case, we will notify you and seek your approval to re-attempt the purchase at the current Conversion Rate (as defined below).
       
6.4. Availability of Payment Methods. 
The availability of a method of payment depends on a number of factors including, for example, where you are located, the identification information you have provided to us, and limitations imposed by third party payment processors.
       
6.5. Conversion Rates. 
Each purchase or sale of Digital Assets is subject to a fee (a “Conversion Rate”). Conversion Rate is defined as the liquidity adjusted price of a given digital asset amount in terms of local currency as quoted on the Crypdom Exchange Site. The Conversion Rate may be stated as a “Buy Price”, the price (in terms of local currency) at which you purchase digital assets from Crypdom Exchange, or as a “Sell Price”, the price (in terms of local currency) at which you sell digital assets to Crypdom Exchange. For the purpose of any transaction which incorporates the Conversion Rate, you agree, as a condition of using any Crypdom Exchange Services, to accept the Conversion Rate as the sole conversion metric. You agree that Crypdom Exchange is solely responsible for setting and determining the Conversion Rate. For all conversions, the prevailing conversion rates will apply; Crypdom Exchange will not guarantee a conversion rate for any particular transaction.

The applicable Conversion Rate will be displayed to you on the Crypdom Exchange Site prior to each transaction and is stated in each receipt we issue to you. We may adjust our Conversion Rates at any time. We will not process a transaction if the Conversion Rate and any other associated fees would, together, exceed the value of your transaction.

We do not guarantee the availability of any Conversion Rate. We do not guarantee that you will be able to buy and/or sell your Digital Assets at any particular price or time.
       
6.6. Authoriza­tions; Reversals; Cancellations. 
By clicking the “Place Order” or “Sell Bitcoins” or “Confirm” button on the Crypdom Exchange Site, you are authorizing Crypdom Exchange to initiate the transaction at the quoted Price and agree to any associated Conversion Rates. You cannot cancel, reverse, or change any transaction marked as complete or pending. If your payment is not successful or if your payment method has insufficient funds, you authorize us, in our sole discretion, either to cancel the transaction or to debit any of your other stored payment methods in any amount necessary to complete the transaction. You are responsible for maintaining an adequate balance and/or sufficient credit limits in order to avoid overdraft, insufficient funds, or similar fees charged by your payment provider.
   
7. TRANSACTION LIMITS AND ENHANCED DUE DILIGENCE
       
7.1. Transaction Limits. 
The use of all Crypdom Exchange Services is subject to a limit on the amount of volume, stated in local currency, you may transact or transfer in a given week. To view your limits, login to your Crypdom Exchange Account and visit the My Limits page. Your transaction limits may vary depending on your payment method, verification steps you have completed, and other factors. We reserve the right to change applicable limits as we deem necessary. If you wish to raise your limits beyond the posted amounts, you may apply for a higher limit.
       
7.2. Enhanced Due Diligence. 
We may require you to submit additional information about yourself and provide additional documents or records (“Enhanced Due Diligence”). At our discretion, we may refuse to raise your limits, or we may lower your limits at a subsequent time even if you have completed Enhanced Due Diligence.

   
8. SUSPENSION, TERMINATION AND CANCELLATION
       
8.1. We may: a) refuse to complete or block, cancel or reverse a transaction you have authorized, b) suspend, restrict, or terminate your access to any or all of the Crypdom Exchange Services, and/or c) deactivate or cancel your Crypdom Exchange Account with immediate effect for any reason, including but not limited to where:
   
i. We are, in our reasonable opinion, required to do so by applicable law or any court or other authority to which we are subject in any jurisdiction;
   
ii. We reasonably suspect you of acting in breach of this Agreement;
   
iii. We reasonably suspect you have breached our Policies;
   
iv. We have concerns that a transaction is erroneous or about the security of your Crypdom Exchange Account or we suspect the Crypdom Exchange Services are being used in a fraudulent or unauthorized manner;
   
v. We suspect money laundering, terrorist financing, fraud, or any other financial crime;
   
vi. If your credit or debit card or any other valid payment method linked to your Account is declined;
   
vii. Use of your Crypdom Exchange Account is subject to any pending litigation, investigation, or government proceeding and/or we perceive a heightened risk of legal or regulatory non-compliance associated with your Crypdom Exchange Account activity; and/or
   
viii. You take any action that may circumvent our controls such as opening multiple Crypdom Exchange Accounts or abusing promotions which we may offer from time to time.
       
8.2. We may also refuse to complete a transaction you have authorized where there are insufficient funds in your Crypdom Exchange Account and/or insufficient Digital Assets in your Crypdom Exchange Account to cover the transaction and (where applicable) associated fees at the time that we receive notification of the transaction.

If we refuse to complete a transaction and/or suspend or close your Crypdom Exchange Account, or terminate your use of Crypdom Exchange Services in this way, we will (unless it would be unlawful for us to do so) provide you with notice of our actions and the reasons for refusal, suspension or closure and where appropriate, with the procedure for correcting any factual errors that led to the refusal, suspension or closure. In the event that we refuse to complete a transaction and/or suspend your Crypdom Exchange Account we will lift the suspension as soon as reasonably practicable once the reasons for refusal and/or suspension no longer exist. However, we are under no obligation to allow you to reinstate a transaction at the same price or on the same terms as the suspended, reversed or cancelled transaction.
       
8.3. We may suspend, restrict, or terminate your access to any or all of the Crypdom Exchange Services and/or deactivate or cancel your Crypdom Exchange Account, without reason by giving you one week of notice. You acknowledge that our decision to take certain actions, including limiting access to, suspending, or closing your Crypdom Exchange Account, may be based on confidential criteria that are essential to our risk management and security protocols. You agree that we are under no obligation to disclose the details of its risk management and security procedures to you.
       
8.4. On termination of this Agreement, unless prohibited by applicable law or by any court or other order to which Crypdom Exchange is subject in any jurisdiction, you may:
   
i. transfer Digital Assets for thirty (30) days thereafter; and/or
   
ii. transfer any fiat balance within thirty (30) days commencing with the date of the termination of the Agreement.

If we suspend or close your account, or terminate your use of Crypdom Exchange Services for any reason, we reserve the right to require you to complete the procedures outlined in Section 3.2.(Identity Verification) before permitting you with transfer or withdraw Digital Assets.

You may cancel your Crypdom Exchange Account at any time by transferring or exchanging all digital assets associated with your Crypdom Exchange Account at the prevailing Conversion Rates. You will not be charged for canceling your Crypdom Exchange Account and will only be required to pay for those Crypdom Exchange Services used that are subject to charges. If any transaction is in a pending state at the time your Crypdom Exchange Account is cancelled or suspended, such transaction may be cancelled and/or refunded as appropriate.

You may not cancel your Crypdom Exchange Account to evade an investigation or avoid paying any amounts otherwise due to us. Upon cancellation of your Crypdom Exchange Account, you authorize us to cancel or suspend pending Crypdom Exchange Transactions and hold any associated funds until we are certain that funding reversal windows are complete. In the event that you or we terminate this Agreement or your access to the Crypdom Exchange Services, or de-activate or cancel your Crypdom Exchange Account, you will remain liable for all amounts due hereunder and will be required to empty your Crypdom Exchange Account by converting your fiat balance (if any) to Digital Assets at the prevailing conversion rates and transfer the Digital Assets out of your Account.

In the event that a technical malfunction causes a system outage or any Crypdom Exchange Account errors, we may temporarily suspend access to your account until the issue is resolved.

9. LIABILITY
       
9.1. Release of Crypdom Exchange. 
If you have a dispute with one or more users of the Crypdom Exchange Services, you agree that neither we nor our affiliates or service providers, nor any of our respective officers, directors, agents, joint ventures, employees, external collaborators and representatives will be liable for any claims, demands and damages (actual and consequential) of any kind or nature arising out of or in any way connected with such disputes.
       
9.2.  Indemnifi­cation. 
You agree to defend, indemnify and hold harmless us (and each of our officers, directors, members, employees, agents, external collaborators and affiliates) from any claim, demand, action, damage, loss, cost or expense, including without limitation reasonable attorneys’ fees, arising out or relating to
(a) your use of, or conduct in connection with, our Services;
(b) any Feedback you provide;
(c) your violation of these Terms; or
(d) your violation of any rights of any other person or entity. If you are obligated to indemnify us, we will have the right, in our sole discretion, to control any action or proceeding (at our expense) and determine whether we wish to settle it.
       
9.3. Limitations of Liability. 
We shall only be liable to you for loss or damage caused directly and reasonably foreseeable by our breach of this Agreement and our liability in these circumstances is limited as set out in the remainder of this section.
(For the avoidance of doubt, the term “loss” includes a partial loss or reduction in value as well as a complete or total loss.)
       
9.4. Liability Cap. 
Except as otherwise provided for in this Agreement, neither we, nor our affiliates or service providers, nor any of our or their respective officers, directors, agents, employees or representatives, will be liable for any amount greater than the combined value of the Digital Asset and your funds balance in your Account at any given time. Where we are considering a specific claim relating to a specific transaction this sum shall be further limited to the amount of the transaction in dispute.
       
9.5. Limitation of Loss. 
In addition to the liability cap at Section 9.4. above, in no event shall we, our affiliates or service providers, or any of our or their respective officers, directors, agents, employees, external collaborators or representatives, be liable for any of the following types of loss or damage arising under or in connection with this Agreement or otherwise:
           
9.5.1. any loss of profits or loss of expected revenue or gains, including any loss of anticipated trading profits and/or any actual or hypothetical trading losses, even if we are advised of or knew or should have known of the possibility of the same. This means, by way of example only (and without limiting the scope of the preceding sentence), that if you claim that we failed to process a buy or sell transaction properly, your damages are limited to no more than the combined value of the supported Digital Asset at issue in the transaction, and that you may not recover for any loss of anticipated trading profits or for any actual trading losses made as a result of the failure to buy or sell;
           
9.5.2. any loss of or damage to reputation or goodwill; any loss of business or opportunity, customers or contracts; any loss or waste of overheads, management or other staff time; or any other loss of revenue or actual or anticipated savings, even if we are advised of or knew or should have known of the possibility of the same;
           
9.5.3. any loss of use of hardware, software or data and/or any corruption of data; including but not limited to any losses or damages arising out of or relating to any inaccuracy, defect or omission of Digital Asset price data; any error or delay in the transmission of such data; and/or any interruption in any such data;
           
9.5.4. any loss or damage whatsoever which does not stem directly from our breach of this Agreement; and/or
          
9.5.5. any loss or damage whatsoever which is in excess of that which was caused as a direct result of our breach of this Agreement (whether or not you are able to prove such loss or damage).
       
9.6. Applicable Law. The limitation of liability in this Section

9.3. is subject to any obligations that we have under applicable law and regulation, including our obligation to exercise reasonable care and skill in our provision of the Crypdom Exchange Services. Nothing in this Agreement shall limit our liability resulting from our fraud or fraudulent misrepresentation, deliberate misconduct, for death or personal injury resulting from either our ne­gligence.
       
9.7. No Warranties. The Crypdom Exchange Site is provided on an “as is”, “with all faults” and “as available” basis. We, our officers, directors, shareholders, employees, external collaborators and agents expressly disclaim all warranties of any kind, expressed, implied or statutory, relating to the Crypdom Exchange Site and its content including without limitation the warranties of title, merchantability, fitness for a particular purpose, non-infringement of proprietary rights, course of dealing or course of performance.

We do not warrant that
a) the Crypdom Exchange Site will meet your specific requirements,

b) the Crypdom Exchange Site will be uninterrupted, timely, secure or error-free,

c) the Crypdom Exchange Transactions will be accurate, error-free, reliable or complete,

d) any errors on the Crypdom Exchange Site will be corrected, or

e) any services through the Crypdom Exchange Site will meet your expectations or requirements.
           
9.7.1. We do not warrant and are not responsible for any injuries or losses sustained by you as a result of your use of the Crypdom Exchange Site. We do not warrant that your use of the Crypdom Exchange Site is lawful in any particular jurisdiction, and we specifically disclaim any such warranties. Some jurisdictions limit or do not allow the disclaimer of implied or other warranties so the above disclaimer may not apply to you to the extent such jurisdiction’s law is applicable to you and this Agreement.

By accessing or using the Crypdom Exchange Site, you represent and warrant that your activities are lawful in every jurisdiction where you access or use the Crypdom Exchange Site.
           
9.7.2. In no event shall we be liable for any damages whatsoever, whether direct, indirect, general, special, exemplary, compensatory, consequential, and/or incidental, arising out of or relating out of, or relating to the conduct of you or anyone else in connection with the use of the Crypdom Exchange Site, including without limitation, loss, impairment, bodily injury, death, emotional distress, damage to your possessions and/or any other damages resulting from any Crypdom Exchange Transactions initiated on the Crypdom Exchange Site, unauthorized access to or alteration of your transmissions to the Crypdom Exchange Site and errors, mistakes or inaccuracies of any content on the Site. You agree to take reasonable precautions when executing Crypdom Exchange Transaction.
           
9.7.3. We make no representations about the accuracy or completeness of historical Digital Asset price data available on the Crypdom Exchange Site.
       
9.8. Safety and Security of Your Computer and Devices. Crypdom Exchange is not liable for any damage or interruptions caused by any computer viruses, spyware, scareware, Trojan horses, worms or other malware that may affect your computer or other equipment, or any phishing, spoofing or other attack. We advise the regular use of a reliable and readily available virus screening and prevention software. You should also use care in reviewing messages purporting to originate from us. Crypdom Exchange customer support will never ask to screen share or otherwise seek to access your computer or account; similarly, we will not ask for your two factor authentication (2FA) codes. Always log into your Crypdom Exchange Account through the Crypdom Exchange Site to review any transactions or required actions if you have any uncertainty regarding the authenticity of any communication or notice.
       
9.9. No Liability for Breach. We are not liable for any breach of the Agreement where the breach is due to abnormal and unforeseeable circumstances beyond our control, the consequences of which would have been unavoidable despite all effects to the contrary, nor are we liable where the breach is due to the application of mandatory legal rules.

10. COMMUNICATIONS AND DISPUTE RESOLUTION
       
10.1. Contact Crypdom Exchange. 
If you have any feedback, questions, or complaints, contact us via email at help@Crypdom Exchange­.net or by submitting a support ticket on the Crypdom Exchange Site. When you contact us please provide us with your name, address, and any other information we may need to identify you, your Crypdom Exchange Account, and the transaction on which you have feedback, questions, or complaints.
       
10.2. Complaints. 
In the event of a complaint, please set out the cause of your complaint, how you would like us to resolve the complaint and any other information you believe to be relevant. We will acknowledge receipt of your complaint if you contact us by submitting a support ticket on the Crypdom Exchange Site.

A Client Relations officer (“Officer”) will consider your complaint. The Officer will consider your complaint without prejudice based on the information you have provided and any information provided by Crypdom Exchange. Within 30 business days of our receipt of your complaint the Officer will address all points raised in your complaint by sending you an e-mail (“Resolution Notice”) in which the Officer will:

(i) offer to resolve your complaint in the way your requested;

(ii) make a determination rejecting your complaint and set out the reasons for the rejection; or

(iii) offer to resolve your complaint with an alternative solution. In exceptional circumstances, if the Officer is unable to respond to your complaint within 30 business days for reasons beyond Crypdom Exchange’s control, the Officer will send you a holding reply indicating the reasons for a delay in answering your complaint and specifying the deadline by which the Officer will respond to your complaint (which will be no later than 60 business days from our receipt of your complaint).
       
10.3. Offers of resolution. Any offer of resolution made to you will only become binding on us if accepted by you. An offer of resolution will not constitute any admission by us of any wrongdoing or liability regarding the subject matter of the complaint.
   
11. DATA PROTECTION
       
11.1. Personal Data. 
You acknowledge that we may process personal data in relation to you (if you are an individual), and personal data that you have provided or in the future provide to us in relation to your employees and other associated or other individuals, in connection with this Agreement, or the Crypdom Exchange Services. Accordingly, you represent and warrant that:
   
• your disclosure to us of any personal data relating to individuals other than yourself was or will be made in accordance with all applicable data protection and data privacy laws, and those data are accurate, up to date and relevant when disclosed;
   
• before providing any such personal data to us, you have read and understood our Privacy Policy attached to this Agreement, and a copy of which is also available at Privacy Policy, and, in the case of personal data relating to an individual other than yourself, have (or will at the time of disclosure have) provided a copy of that Privacy Policy (as amended from time to time), to that individual; and
   
• if from time to time we provide you with a replacement version of the Privacy Policy, you will promptly read that notice and provide a copy to any individual whose personal data you have provided to us.

12. Third-Party Content
       
12.1. In using our Services, you may view content provided by third parties, including links to web pages of such parties, including but not limited to Facebook and Twitter links ("Third-Party Content"). We do not control, endorse or adopt any Third-Party Content and shall have no responsibility for Third-Party Content, including without limitation material that may be misleading, incomplete, erroneous, offensive, indecent or otherwise objectionable. In addition, your business dealings or correspondence with such third parties are solely between you and the third parties. We are not responsible or liable for any loss or damage of any sort incurred as the result of any such dealings, and you understand that your use of Third-Party Content, and your interactions with third parties, is at your own risk.

13. ACCEPTABLE AND PROHIBITED USE          
       
13.1. Limited License. 
We grant you a limited, non-exclusive, non-transferable license, subject to the terms of this Agreement, to access and use the Crypdom Exchange Site, and related content, materials, information (collectively, the “Content”) solely for approved purposes as permitted by us from time to time. Any other use of the Crypdom Exchange Site or Content is expressly prohibited and all other right, title, and interest in the Crypdom Exchange Site or Content is exclusively the property of Crypdom Exchange and its licensors. You agree not to copy, transmit, distribute, sell, license, reverse engineer, modify, publish, or participate in the transfer or sale of, create derivative works from, or in any other way exploit any of the Content, in whole or in part. “Crypdom Exchange.com”, “Crypdom Exchange” and all logos related to the Crypdom Exchange Services or displayed on the Crypdom Exchange Site are trademarks or registered marks of Crypdom Exchange or its licensors. You may not copy, imitate or use them without our prior written consent.

13.2. Website Accuracy. 
Although we intend to provide accurate and timely information on the Crypdom Exchange Site, the Crypdom Exchange Site (including, without limitation, the Content) may not always be entirely accurate, complete or current and may also include technical inaccuracies or typographical errors. In an effort to continue to provide you with as complete and accurate information as possible, information may, to the extent permitted by applicable law, be changed or updated from time to time without notice, including without limitation information regarding our policies, products and services. Accordingly, you should verify all information before relying on it, and all decisions based on information contained on the Crypdom Exchange Site are your sole responsibility and we shall have no liability for such decisions. Links to third-party materials (including without limitation websites) may be provided as a convenience but are not controlled by us. You acknowledge and agree that we are not responsible for any aspect of the information, content, or services contained in any third-party materials or on any third party sites accessible or linked to the Crypdom Exchange Site.
       
13.3. Third Party Applications. 
In order to access Crypdom Exchange Services users are required to provide an email address and create a password. Crypdom Exchange offers two factor authentication (2FA) via a user’s mobile device (Short Message Service, SMS, or a supported Time-based One Time Password, TOTP, application). A verified phone number is required to enable two factor authentication (2FA) via SMS. Users are responsible for keeping electronic devices through which Crypdom Exchange Services is accessed safe and maintaining adequate security and control of any and all security details that are used to access the Crypdom Exchange Services.

This includes taking all reasonable steps to avoid the loss, theft or misuse of said electronic devices and ensuring that said electronic devices are password protected. Any loss or compromise of personal electronic devices or security details may result in unauthorized access of a user’s Crypdom Exchange Account by third-parties and the loss or theft of Digital Assets and/or funds held in your Crypdom Exchange Account and the misuse of any associated accounts, including linked bank account(s) and credit/debit card(s).

Users must keep security details safe at all times. For example, passwords and TOTP authentication seeds be safeguarded and not shared or made visible to others. Crypdom Exchange strongly recommends the use of password and second factor protected password managers to safeguard login credentials and Personal Identification Numbers, PINs, and/or biometric authentication features to safeguard second factor generating mobile devices.
       
13.4. Export Controls and Sanctions. 
Your use of the Crypdom Exchange Services and the Crypdom Exchange Site is subject to international export controls and economic sanctions requirements by sending, receiving, buying, selling, trading or storing Digital Assets through the Crypdom Exchange Site or Crypdom Exchange Services, you agree that you will comply with those requirements. You are not permitted to use any of the Crypdom Exchange Services through the Crypdom Exchange Site if:

(1) you are in, under the control of, or a national or resident of Cuba, North Korea, Syria, or any other country subject to international sanctions (a “Sanctioned Country”); or

(2) you intend to supply any acquired or stored Digital Assets or Crypdom Exchange Services to a Sanctioned Country (or a national or resident of a Sanctioned Country). The Crypdom Exchange Services will not be provided to any of the OFAC (sanctioned) countries in accordance with the law of the UA. In the event that we learn that you are making any such prohibited payments or wallet transactions, we may lower your weekly transaction limits, suspend or terminate your account.
       
13.5. Amendments. The website policies may be changed/updated as per requirements and standards. Hence you are encouraged to frequently visit this section in order to be aware of the latest updates to this Agreement. Modifications will be effective on the day they are posted.

If you do not accept any change to the Terms of Use, you should stop using the Site immediately. Your continued use of the Site following any change constitutes your acceptance of the change and you will be legally bound by the new updated Terms of Use.
       
13.6. No waiver.
No failure or delay by us in exercising any right, power or privilege under the Terms of Use shall operate as a waiver of such right or acceptance of any variation of the Terms of Use and nor shall any single or partial exercise by either party of any right, power or privilege preclude any further exercise of that right or the exercise of any other right, power or privilege.

Nothing in the Terms of Use shall confer on any other third party any benefit or the right to enforce any term of the Terms of Use.
       
13.7. Relationship of the Parties. 
This Agreement is binding upon and shall inure to the benefit of both parties and their respective successors, heirs, executors, administrators, personal representatives, and permitted assigns. You may not assign this Agreement without our prior written consent. No third party shall have any rights hereunder.
       
13.8. Privacy of Others; Marketing. 
If you receive information about another user through the Crypdom Exchange Services, you must keep the information confidential and only use it in connection with the Crypdom Exchange Services. You may not disclose or distribute a user’s information to a third party or use the information except as reasonably necessary to effect a transaction and other functions reasonably incidental thereto such as support, reconciliation and accounting unless you receive the user’s express consent to do so. You may not send unsolicited email to a user through the Crypdom Exchange Services.
       
13.9. Password Security. 
In order to access Crypdom Exchange Services you will be required to create or be given security details, including a username and password. You are responsible for keeping the electronic device through which you access Crypdom Exchange Services safe and maintaining adequate security and control of any and all security details that you use to access the Crypdom Exchange Services. This includes taking all reasonable steps to avoid the loss, theft or misuse of such electronic device and ensuring that such electronic device is encrypted and password protected. Any loss or compromise of your electronic device or your security details may result in unauthorized access to your Crypdom Exchange Account by third parties and the loss or theft of Digital Assets and/or funds held in your Crypdom Exchange Account and any associated accounts, including your linked bank account(s) and credit card(s). You must keep your security details safe at all times. For example, you should not write them down or otherwise make them visible to others.
       
13.10. Security Breach. 
If you suspect that your Crypdom Exchange Account or any of your security details have been compromised or if you become aware of any fraud or attempted fraud or any other security incident (including a cyber-security attack) affecting you and/or Crypdom Exchange (together a “Security Breach”), you must notify Crypdom Exchange as soon as possible by email free of charge via email at help@crypdom.com and continue to provide accurate and up to date information throughout the duration of the Security Breach.

You must take any steps that we reasonably require to reduce, manage or report any Security Breach. Failure to provide prompt notification of any Security Breach may be taken into account in our determination of the appropriate resolution of the matter.
       
13.11. Contact Information. 
You are responsible for keeping your email address and telephone number up to date in your Account Profile in order to receive any notices or alerts that we may send you (including notices or alerts of actual or suspected Security Breach).
       
13.12. Taxes. 
It is your responsibility to determine whether, and to what extent, any taxes apply to any transactions you conduct through the Crypdom Exchange Services, and to withhold, collect, report and remit the correct amounts of taxes to the appropriate tax authorities. Your transaction history is available through your Crypdom Exchange Account.
       
13.13. Unclaimed Property.
If we hold a Peripheral Account balances or Digital Assets, and we are unable to contact you and have no record of your use of the Crypdom Exchange Services for several years, applicable law may require us to report the Peripheral Account balance or Digital Asset balance as unclaimed property to the authorities in certain jurisdictions.

We will try to locate you at the address shown in our records, but if we are unable to, we may be required to deliver any such Peripheral Account balances or Digital Assets to the authorities in certain jurisdictions as unclaimed property. We reserve the right to deduct a dormancy fee or other administrative charges from such unclaimed funds, as permitted by applicable law.
       
13.14. Entire Agreement. 
This Agreement (including documents incorporated by reference herein) comprise the entire agreement between you and Crypdom Exchange.
       
13.15. Interpre­tation. 
Section headings in this Agreement are for convenience only, and shall not govern the meaning or interpretation of any provision of this Agreement.
       
13.16. Transfer. 
This Agreement is personal to you and you cannot transfer or assign your rights, licenses, interests and/or obligations to anyone else. We may transfer or assign our rights licenses, interests and/or our obligations at any time, including as part of a merger, acquisition or other corporate reorganization involving Crypdom Exchange, provided that this transfer or assignment does not materially impact the quality of the Crypdom Exchange Services you receive.
       
13.17. Security Interests. 
You must not create security over your Pheripheral Account balance or Digital Assets unless we say you can in writing.
       
13.18. Invalidity. 
If any provision of this Agreement is determined to be invalid or unenforceable under any applicable law, this will not affect the validity of any other provision.
       
13.19. Enforcement of Our Rights. 
We may not always strictly enforce our rights under this Agreement. If we do this, it will be just a temporary measure and we may enforce our rights strictly again at any time.
       
13.20. Language. 
This Agreement and any information or notifications that you or we are to provide should be in English. Any translation of this Agreement or other documents is provided for your information only. In the event of any inconsistency, the English language version of this Agreement or other documents shall prevail.
       
13.21. Survival. 
All provisions of this Agreement which by their nature extend beyond the expiration or termination of this Agreement, including, without limitation, the sections relating to suspension or termination, Crypdom Exchange Account cancellation, debts owed to Crypdom Exchange, general use of the Crypdom Exchange Site, disputes with Crypdom Exchange, and general provisions, will continue to be binding and operate after the termination or expiration of this Agreement.

If, for any reason, any of the Terms of Use are declared to be illegal, invalid or otherwise unenforceable by a court of a competent jurisdiction, then to the extent that term is illegal, invalid or unenforceable, it shall be severed and deleted from the Terms of Service and the remainder of the Terms of Use shall survive, remain in full force and effect, and continue to be binding and enforceable.

APPENDIX 2: PROHIBITED USE, PROHIBITED BUSINESSES AND CONDITIONAL USE
PROHIBITED USE

You may not use your Crypdom Exchange Account to engage in the following categories of activity (“Prohibited Uses”). The specific types of use listed below are representative, but not exhaustive. If you are uncertain as to whether or not your use of Crypdom Exchange Services involves a Prohibited Use, or have questions about how these requirements apply to you, please submit a request by submitting a support ticket on the Crypdom Exchange Site. By opening a Crypdom Exchange Account, you confirm that you will not use your Account to do any of the following:
   
• Unlawful Activity: Activity which would violate, or assist in violation of, any law, statute, ordinance, or regulation, sanctions programs administered in the countries where Crypdom Exchange conducts business, including but not limited to the Office of Foreign Assets Control (“OFAC”), or which would involve proceeds of any unlawful activity; publish, distribute or disseminate any unlawful material or information
   
• Abusive Activity: Actions which impose an unreasonable or disproportionately large load on our infrastructure, or detrimentally interfere with, intercept, or expropriate any system, data, or information; transmit or upload any material to the Crypdom Exchange Site that contains viruses, trojan horses, worms, or any other harmful or deleterious programs; attempt to gain unauthorized access to the Crypdom Exchange Site, other Crypdom Exchange Accounts, computer systems or networks connected to the Crypdom Exchange Site, through password mining or any other means; use Crypdom Exchange Account information of another party to access or use the Crypdom Exchange Site, except in the case of specific Merchants and/or applications which are specifically authorized by a user to access such user’s Crypdom Exchange Account and information; or transfer your account access or rights to your account to a third party, unless by operation of law or with the express permission of Crypdom Exchange
   
• Abuse Other Users: Interfere with another individual’s or entity’s access to or use of any Crypdom Exchange Services; defame, abuse, extort, harass, stalk, threaten or otherwise violate or infringe the legal rights (such as, but not limited to, rights of privacy, publicity and intellectual property) of others; incite, threaten, facilitate, promote, or encourage hate, racial intolerance, or violent acts against others; harvest or otherwise collect information from the Crypdom Exchange Site about others, including without limitation email addresses, without proper consent
   
• Fraud: Activity which operates to defraud Crypdom Exchange, Crypdom Exchange users, or any other person; provide any false, inaccurate, or misleading information to Crypdom Exchange
   
• Gambling: Lotteries; bidding fee auctions; sports forecasting or odds making; fantasy sports leagues with cash prizes; internet gaming; contests; sweepstakes; games of chance
   
• Intellectual Property Infringement: Engage in transactions involving items that infringe or violate any copyright, trademark, right of publicity or privacy or any other proprietary right under the law, including but not limited to sales, distribution, or access to counterfeit music, movies, software, or other licensed materials without the appropriate authorization from the rights holder; use of Crypdom Exchange intellectual property, name, or logo, including use of Crypdom Exchange trade or service marks, without express consent from Crypdom Exchange or in a manner that otherwise harms Crypdom Exchange or the Crypdom Exchange brand; any action that implies an untrue endorsement by or affiliation with Crypdom Exchange.

PROHIBITED BUSINESSES
In addition to the Prohibited Uses described above, the following categories of businesses, business practices, and sale items are barred from Crypdom Exchange Services (“Prohibited Businesses”). Most Prohibited Businesses categories are imposed by Card Network rules or the requirements of our banking providers or processors. The specific types of use listed below are representative, but not exhaustive. If you are uncertain as to whether or not your use of Crypdom Exchange Services involves a Prohibited Business, or have questions about how these requirements apply to you, please contact us by submitting a support ticket on the Crypdom Exchange Site.

By opening a Crypdom Exchange Account, you confirm that you will not use Crypdom Exchange Services in connection with any of following businesses, activities, practices, or items:
   
• Investment and Credit Services: Securities brokers; mortgage consulting or debt reduction services; credit counseling or repair; real estate opportunities; investment schemes
   
• Restricted Financial Services: Check cashing, bail bonds; collections agencies
   
• Intellectual Property or Proprietary Rights Infringement: Sales, distribution, or access to counterfeit music, movies, software, or other licensed materials without the appropriate authorization from the rights holder
   
• Counterfeit or Unauthorized Goods: Unauthorized sale or resale of brand name or designer products or services; sale of goods or services that are illegally imported or exported or which are stolen
   
• Regulated Products and Services: Marijuana dispensaries and related businesses; sale of tobacco, e-cigarettes, and e-liquid; online prescription or pharmaceutical services; age restricted goods or services; weapons and munitions; gunpowder and other explosives; fireworks and related goods; toxic, flammable, and radioactive materials
   
• Drugs and Drug Paraphernalia: Sale of narcotics, controlled substances, and any equipment designed for making or using drugs, such as bongs, vaporizers, and hookahs
   
• Pseudo-Pharmaceuticals: Pharmaceuticals and other products that make health claims that have not been approved or verified by the applicable local and/or national regulatory body
   
• Substances designed to mimic illegal drugs: Sale of a legal substance that provides the same effect as an illegal drug (e.g., salvia, kratom)
   
• Adult Content and Services: Pornography and other obscene materials (including literature, imagery and other media); sites offering any sexually-related services such as prostitution, escorts, pay-per view, adult live chat features
   
• Multi-level Marketing: Pyramid schemes, network marketing, and referral marketing programs
   
• Unfair, predatory or deceptive practices: Investment opportunities or other services that promise high rewards; Sale or resale of a service without added benefit to the buyer; resale of government offerings without authorization or added value; sites that we determine in our sole discretion to be unfair, deceptive, or predatory towards consumers
   
• High risk businesses: any businesses that we believe poses elevated financial risk, legal liability, or violates card network or bank policies.

RESTRICTED ACTIVITIES
Using the Services to make the following types of transactions is prohibited; Crypdom Exchange reserves the right to monitor for payments or wallet transactions that relate to:
   
• any restricted persons, sanctioned or restricted countries as defined by the United Arab Emirates government;
   
• any sort of ponzi scheme, pyramid scheme, or multi-level marketing program;
   
• constitute money-laundering or terrorist financing;
   
• controlled substances including but not limited to narcotics, prescription drugs, steroids, or related paraphernalia or accessories;
   
• counterfeit goods;
   
• court ordered payments, structured settlements, tax payments, or tax settlements;
   
• Cryptocurrency tumbling (or ‘mixer’) services or websites;
   
• Darknet Markets;
   
• debt settlement, refinance, or credit repair services;
   
• Decentralized cryptocurrency exchanges such as LocalBitcoins;
   
• gambling activities including but not limited to sports betting, casino games, horse racing, dog racing, lotteries, games of chance, sweepstakes, games of skill that may be classified as gambling (i.e. poker), or other activities that facilitate any of the foregoing;
   
• goods or services that infringe or violate any copyright, trademark, or proprietary rights under the laws of any jurisdiction otherwise constitute counterfeit goods;
   
• lottery contracts, layaway systems, or annuities;
   
• the sale of money orders or cashier’s checks or any unlicensed money transmitter activity;
   
• weapons of any kind, including but not limited to firearms, ammunition, knives, or related accessories or;
   
• any other matters which we communicate to you that are unacceptable from time to time and which, for example, may be restricted by our and your payment partners.
Transfers of acquired or stored digital assets to/from individuals or exchanges based in Cuba, North Korea, Iran, Syria or any other country subject to international sanctions are also prohibited.

In the event that Crypdom Exchange learns that you are making any such prohibited payments or wallet transactions, Crypdom Exchange may lower your weekly transaction limits, suspend or terminate your account.
You are entitled to operate one verified account at a time and cannot register and operate more than one account. Crypdom Exchange reserves the right to suspend or terminate any such accounts found over the period.

APPENDIX 3: VERIFICATION PROCEDURES AND LIMITS
Crypdom Exchange uses multi-level systems and procedures to collect and verify information about you in order to protect Crypdom Exchange and the community from fraudulent users, and to keep appropriate records of Crypdom Exchange’s cus­tomers. Your access to one or more Crypdom Exchange Services, and limits including daily or weekly deposit, withdrawal and trading limits, may be based on the identifying information and/or proof of identity you provide to Crypdom Exchange.

Crypdom Exchange may require you to provide or verify additional information, or to wait some amount of time after completion of a transaction, before permitting you to use any Crypdom Exchange Services and/or before permitting you to engage in transactions beyond certain volume limits. You may determine the volume limits associated with your level of identity verification by visiting the My Limits page.

If you wish to raise your limits beyond the posted amounts, you may apply for a higher limit. Crypdom Exchange will require you to submit to Enhanced Due Diligence. Additional fees and costs may apply, and Crypdom Exchange does not guarantee that we will raise your limits.

APPENDIX 4: E-SIGN DISCLOSURE AND CONSENT
This policy describes how Crypdom Exchange delivers communications to you electronically. We may amend this policy at any time by providing a revised version on our website. The revised version will be effective at the time we post it. We will provide you with prior notice of any material changes via our website.

ELECTRONIC DELIVERY OF COMMUNICATIONS
You agree and consent to receive electronically all communications, agreements, documents, notices and disclosures (collectively, “Communications”) that we provide in connection with your Crypdom Exchange Account and your use of Crypdom Exchange Services. Communications include:
   
• Terms of use and policies you agree to (e.g., the Crypdom Exchange User Agreement and Privacy Policy), including updates to these agreements or policies;
   
• Account details, history, transaction receipts, confirmations, and any other Account or transaction information;
   
• Legal, regulatory, and tax disclosures or statements we may be required to make available to you; and
   
• Responses to claims or customer support inquiries filed in connection with your Account.
We will provide these Communications to you by posting them on the Crypdom Exchange website, emailing them to you at the primary email address listed in your Crypdom Exchange profile, and/or through other electronic communication such as text message or mobile push notification.

HOW TO WITHDRAW YOUR CONSENT
You may withdraw your consent to receive Communications electronically by submitting a support ticket on the Crypdom Exchange Site. If you fail to provide or if you withdraw your consent to receive Communications electronically, Crypdom Exchange reserves the right to immediately close your Account or charge you additional fees for paper copies.

UPDATING YOUR INFORMATION
It is your responsibility to provide us with a true, accurate and complete e-mail address and your contact information, and to keep such information up to date. You understand and agree that if Crypdom Exchange sends you an electronic Communication but you do not receive it because your primary email address on file is incorrect, out of date, blocked by your service provider, or you are otherwise unable to receive electronic Communications, Crypdom Exchange will be deemed to have provided the Communication to you.

You may update your information by logging into your account and visiting settings or by submitting a support ticket on the Crypdom Exchange Site.
